In the past months of demonstrations for Black lives, there has been a lot of condemnation of looting. Whether it was New York Gov. Andrew Cuomo saying that stealing purses and sneakers from high-end stores in Manhattan was "inexcusable," or St. Paul, Minn., Mayor Melvin Carter saying looters were "destroy[ing] our community," police officers, government officials and pundits alike have denounced the property damage and demanded an end to the riots. And just last week, rioters have burned buildings and looted stores in Kenosha, Wis., following the police shooting of Jacob Blake, to which Sen. Ron Johnson, R-Wis., has said: "Peaceful protesting is a constitutionally protected form of free speech. Rioting is not."
When she finished it, back in April, she wrote that "a new energy of resistance is building across the country." Now, as protests and riots continue to grip cities, she stakes out a provocative position: that looting is a powerful tool to bring about real, lasting change in society. The rioters who smash windows and take items from stores, she claims, are engaging in a powerful tactic that questions the justice of "law and order," and the distribution of property and wealth in an unequal society.
When I use the word looting, I mean the mass expropriation of property, mass shoplifting during a moment of upheaval or riot. That's the thing I'm defending. I'm not defending any situation in which property is stolen by force. It's not a home invasion either. It's about a certain kind of action that's taken during protests and riots.
"Rioting" generally refers to any moment of mass unrest or upheaval. Riots are a space in which a mass of people has produced a situation in which the general laws that govern society no longer function, and people can act in different ways in the street and in public. I'd say that rioting is a broader category in which looting appears as a tactic.
But there's also another factor, which is anti-Blackness and contempt for poor people who want to live a better life, which looting immediately provides. One thing about looting is it freaks people out. But in terms of potential crimes that people can commit against the state, it's basically nonviolent. You're mass shoplifting. Most stores are insured; it's just hurting insurance companies on some level. It's just money. It's just property. It's not actually hurting any people.
This hybrid seminar will present a brief overview of the history of looting and the destruction of art and archaeology from antiquity to the present, the relationship of cultural property to human rights, as well as the challenges and potential solutions to this ongoing problem. We will also explore a sampling of laws and cases related to looting and art crime.

During riots, natural disasters and other states of emergencies, there is always a risk that members of the public will take advantage of the chaos around them and will engage in theft and crime offenses. This happened in 1992 after the Rodney King verdict was announced and the entire city of Los Angeles was thrown into chaos. Under California Penal Code Section 463 PC, the act of looting is a crime that can carry serious consequences for those convicted.
After winning a championship game, throngs of celebrating fans begin to riot in the streets around the sports arena. Fans begin smashing the windows of stores and stealing the items within. One of the revelers sees other people in an electronics store, so he goes inside and grabs a portable stereo. This man could be charged with looting as well as the underlying commercial burglary offense, because he broke into the store during a riot, which would be considered a manmade emergency, and committed a theft/burglary offense.
In another example, a town is devastated during a major earthquake and all roads and services are cut off. A man in desperation breaks into a local convenience store to take water, food and other necessities. This man probably would not be charged with looting under California Penal Code Section 463 PC, as he would have a strong necessity defense.
As noted above, someone may have a valid defense to an allegation of looting if they committed the theft or burglary offense out of absolute necessity. In addition, if the underlying offense was not one of the ones specifically enumerated by statute, there would be no criminal liability for looting. That means that someone who fights in the streets during a riot could not be prosecuted for looting but could be prosecuted for another crime like battery, disturbing the peace, or participating in a riot.

Antiquities looting rips artifacts out of their historical and archaeological context. It deprives countries of their cultural property, and instead allows those artifacts to be sold or auctioned to wealthy individuals on the private market. Current enforcement mechanisms provide inadequate deterrence to the secondary market for these antiquities. A recent amendment to the Bank Secrecy Act could provide a solution. However, regulations enacted pursuant to that amendment should not simply transpose requirements and red flags from the financial context to the art context. They should look beyond concerns that looting might be used to fund terrorism and should instead consider looting a harm and illegal activity in and of itself. When drafting regulations FinCEN could look to voluntary museum guidance and provenance guides to identify risk factors and red flags particular to looting. These include the condition of the antiquities, their geographic source, their provenance documentation, and whether they appear in a stolen art database. These changes could hopefully lead to a more transparent, compliant antiquities market.
